Four Decades of Incomparable Litigation Expertise

Bill McLellan, Esq.

Stellantis Vice President, Product, Warranty, Commercial, Class Action, Auto/General Liability Litigation 

After a 40-year career of successfully managing most types of litigation, Bill retired from Stellantis at the end of 2024, and in January 2025, formed McLellan ADR Services PLLC, putting his long-honed skills in evaluating and resolving matters to work in assisting parties in achieving settlements. 
 
Bill brings to the litigation landscape a unique skill set, having managed nationwide dockets across multiple litigation streams — from matters involving successful verdicts with nine figures at stake, to nine-figure settlements, to creative solutions for resolving high-volume pattern litigation (e.g., asbestos and automotive warranty litigation). 

Bill's experience is IMmeasurable

During his career, he often played the unique role of not only evaluating matters but also serving as the “go-to” person for granting authority — thus acting as the decision-making client. On occasion, involving high-stakes matters, Bill would “be in the room,” making presentations and recommendations to very senior-level management on case resolutions. 

Through this experience, Bill is keenly aware of factors and messaging that are important to senior-level decision-makers — and can assist counsel in crafting approaches designed to not only achieve fair resolutions but also obtain high-level client approvals. 
 
While serving as a third-party neutral mediator is a new role for Bill, he has participated in a significant number of mediations over his four-decade career and brings this experience to serving as a mediator. While on most occasions Bill has been in the role of participating in mediations from a defense perspective, he has also been on the plaintiff’s side on several matters, particularly in commercial and insurance matters.

A Different Approach to Mediation

While not required, Bill encourages parties to work together in preparing for a mediation. More specifically, he requests litigants prepare a document similar to what many judges request in a final pre-trial report.

Bill welcomes receiving pre-mediation briefs from each party prior to a scheduled mediation and requests receipt of them at least five days before a mediation.

Case Evaluation

While Bill’s focus is on assisting parties in achieving case settlements, he has found during his career that there are occasions where clients simply want a third-party neutral to examine the strength of their cases and provide an independent perspective on the outcome of a matter. While serving as Vice President at Stellantis, Bill demonstrated a propensity for making the right calls in valuing cases and taking verdicts.

During his career, he rendered judgments not only on a matter’s settlement value, but also a matter’s potential outcome if tried to verdict. Working with outstanding counsel and jury research consultants, Bill had over a 90 percent success rate on matters taken to trial.

MEDIATION LOCATION

In the wake of the evolution of litigation in the post-COVID-19 world, and for cost containment reasons, most mediations will be performed via Zoom or Microsoft Teams.

However, there are occasions when mediations can be more effective when done in person. To efficiently manage cost, in person mediations can be undertaken at third-party neutral law firms or using conference rooms at conveniently located hotels.
